Kamel Ride Terms of Service

1. Acceptance of Terms
By accessing or using the Kamel Ride mobile application or website (the “Platform” or “Service”), you agree to be bound by these Terms of Service (the “Terms” or “Agreement”). If you do not agree to these Terms, do not use the Platform. These Terms apply to all users, including Riders, Drivers, and visitors. Your continued use of the Platform constitutes acceptance of the most current version of these Terms.


2. About Kamel Ride
Kamel Ride is operated by Ted Lim Mobility LLC, a Delaware limited liability company (“Kamel Ride,” “we,” “us,” or “our”). The Platform provides a community-based marketplace that connects independent Drivers with Riders for intercity travel. Kamel Ride is a technology provider and marketplace; it does not employ Drivers, own or operate vehicles, or provide transportation services. Kamel Ride is not a Transportation Network Company (TNC) or common carrier.
The Platform is designed solely to facilitate non-commercial carpooling and cost-sharing among users. Drivers may receive partial reimbursement to offset trip costs (e.g., fuel, tolls, reasonable vehicle wear). Rides are not provided for profit, and Drivers may not operate a for-hire transportation service through the Platform. Pickup and drop-off details are coordinated between users.


3. User Roles
Driver: A user who offers and provides rides using their own vehicle.
Rider: A user who books a seat in a Driver’s vehicle for a scheduled trip.
User: Any person accessing or interacting with the Platform.
Kamel Ride facilitates discovery and coordination of trips but does not guarantee the quality, timing, safety, or occurrence of any ride.


4. Driver Responsibilities and Liability
Independent Status. Drivers are independent users—not employees, agents, joint venturers, or contractors of Kamel Ride.
Driver obligations. Drivers are solely responsible for: (i) complying with all traffic and transportation laws; (ii) maintaining a valid driver’s license, registration, and minimum required insurance; and (iii) ensuring their vehicle is safe, legal, and operable. Kamel Ride may request proof but does not guarantee verification beyond user attestations.
Cost-Sharing Guidance (U.S.). Drivers should price trips to reasonably reflect shared costs (fuel, tolls, reasonable vehicle wear) and avoid amounts that resemble for-profit transportation. Any reference to government mileage rates (e.g., IRS standard mileage rate) is for guidance only and does not determine taxability or whether a ride is “commercial.” Users are solely responsible for their own legal and tax compliance.
Accidents and conduct. Drivers are solely liable for any accidents, damages, injuries, losses, or claims arising during a ride, including those due to negligence, recklessness, or unlawful behavior.


5. Rider Responsibilities
Riders agree to: (i) arrive on time at the agreed pickup; (ii) wear seat belts and follow applicable laws; (iii) behave respectfully toward Drivers and Riders; and (iv) book only rides they are comfortable taking. Riders assume all risks of participating in rides.


5A. Minors and Child Safety
Users must be 18+ to hold an account or book a seat. Unaccompanied minors are not permitted. If traveling with a minor, the account holder must accompany the minor and ensure legally required child/booster restraints are used. Drivers may decline boarding where required restraints are missing; such cases may be treated as Rider-initiated cancellations under Section 7.6.


5B. Prohibited Items and Conduct
For safety, the following are prohibited: illegal drugs; open containers of alcohol; hazardous materials; firearms or weapons in violation of law; harassment, threats, or violence; riding without a seat belt; smoking or vaping without Driver consent. Drivers may decline boarding or end a ride if safety is at risk; refunds follow Section 7.6.


6. Verification and Safety Measures
Kamel Ride may implement optional checks (e.g., photo matching, limited document review) but does not conduct comprehensive background checks and does not guarantee user identity, insurance status, or vehicle condition. Users participate at their own risk. Where lawful and disclosed, Drivers and Riders may use dashcams or audio/video recording; by riding, you consent to incidental recording consistent with applicable law.


7. Payments and Fees


7.1 Required On-Platform Payments (No Circumvention).
All bookings must be paid through our integrated processor, Stripe, Inc. (“Stripe”). Off-platform payments for rides arranged on Kamel Ride are prohibited unless we expressly permit them in writing.


7.2 Stripe; Limited Payment Collection Agent.
Kamel Ride uses Stripe to process Rider payments and to disburse payouts to Drivers via Stripe Connect. By using the Platform, you authorize Kamel Ride to act as the Driver’s limited payment collection agent for accepting Rider payments and instructing Stripe to transfer payouts to Drivers, subject to these Terms and Stripe’s terms. Funds may be held by Stripe (or its financial partners) before any payout.


7.3 Stripe Terms; KYC.
Riders authorize charges for the full booking amount at the time of booking. Drivers must create and maintain a valid Stripe Connect account, complete any required “Know Your Customer” (KYC) verification, and link a supported bank account to receive payouts. Your use of payments/payouts is subject to Stripe’s Services Agreement and the Stripe Connected Account Agreement. Failure to satisfy Stripe’s requirements may delay, limit, or prevent payouts.


7.4 Payout Timing; Holds; Adjustments.
Payout timing depends on Stripe, your bank, and risk reviews. We may place a hold, delay, or reverse a payout (and/or instruct Stripe to do so) for reasons including suspected fraud, dispute/chargeback risk, policy violations, compliance reviews, or failure of a ride to occur. You authorize Kamel Ride and Stripe to debit, set off, or recover amounts from Driver payouts or a linked account to resolve refunds, chargebacks, reversals, or fees arising from transactions.


7.5 Platform Service Fees and Processing Fees (Updated)
Kamel Ride charges a service fee on certain bookings. Service fees may vary by trip type, demand, user type, location, or other operational considerations. The specific service fee applicable to a ride will be displayed at checkout before a Rider confirms payment.

Kamel Ride may change its service fee structure at any time with notice. Any changes will apply prospectively and will not affect bookings already completed.

Stripe processes all payments and payouts. Processing fees may be included within Kamel Ride’s service fee or may be itemized separately. Kamel Ride may modify cost allocations at any time.


7.6 Cancellations, Refunds and No-Shows


7.6.1 Definitions.
Trip Start Time: Posted departure time on the trip card (origin local time).
Pickup Window / Grace Period: Up to 10 minutes after Trip Start Time, unless otherwise agreed in-app.
No-Show (Rider): Rider fails to arrive within the Pickup Window or declines to board without Driver fault.
No-Show (Driver): Driver fails to arrive within the Pickup Window or is unreachable and the ride does not proceed.
Force Majeure Event: Weather emergency, natural disaster, major road closure, public-safety incident, or other event outside a party’s reasonable control.


7.6.2 Driver Cancellations and Material Changes.
If a Driver cancels after booking, the Rider receives a 100% refund. Treated as Driver cancellations (unless Rider agrees to proceed): (a) Driver No-Show; (b) delay greater than 60 minutes beyond Trip Start Time; (c) material change to route/pickup/drop-off that meaningfully affects the Rider’s trip. Repeated Driver cancellations/No-Shows may result in account actions.


7.6.3 Rider Cancellations (Standard Window).
Unless a different policy is shown at checkout:
• ≥ 72 hours before Trip Start Time: 100% refund
• < 72 hours before Trip Start Time or after boarding: 0% refund
Kamel Ride may grant a one-time goodwill refund in limited cases (e.g., clear app error), at its discretion.


7.6.4 No-Shows.
Rider No-Show: No refund (Driver may depart after the Pickup Window).
Driver No-Show: 100% refund to the Rider.


7.6.5 Safety and Force Majeure.
Either party may cancel for safety reasons or due to a Force Majeure Event. If the Driver cancels on this basis, Rider receives 100% refund. If the Rider cancels before boarding on this basis, Kamel Ride may authorize up to 100% refund upon reasonable evidence.


7.6.6 Partial Trips; Early Termination; Major Delays.
If a Driver ends a trip early for reasons within the Driver’s control, Rider is eligible for a pro-rata refund, up to 100% if no meaningful portion was completed. If delay exceeds 60 minutes and Rider cancels before boarding, Rider is eligible for a 100% refund. If a Rider exits early by choice (not due to Driver fault), no refund is required.


7.6.7 Refund Method; Payout Adjustments.
Refunds are returned to the original payment method via Stripe where feasible. Timing depends on Stripe and card networks. You authorize Kamel Ride/Stripe to debit or reverse amounts from Driver payouts or linked accounts to process refunds, chargebacks, reversals, or related fees.


7.6.8 Disputes; Evidence; Deadline.
If you believe a refund outcome is incorrect, contact [email protected] within 72 hours of the Trip Start Time (or discovery of the issue) and include supporting evidence (e.g., in-app chat, location screenshots, photos). We may request more information and will make a good-faith determination at our discretion.


7.6.9 Abuse and Repeated Violations.
Circumventing this policy, manipulating bookings, or repeated cancellations/No-Shows may lead to warnings, loss of booking privileges, withholding of payouts, or suspension/termination.


7.7 Chargebacks and Payment Disputes.
If a Rider disputes a charge, you authorize Kamel Ride/Stripe to deduct the disputed amount and any processor/network fees from Driver payouts or a linked account. Kamel Ride may provide evidence and make a good-faith determination regarding refunds; this does not waive any rights under applicable law.


7.8 Damage, Cleaning and Tolls.
If a Driver reports material damage or excessive soiling attributable to a Rider or the Rider’s guests, Kamel Ride may charge a reasonable damage/cleaning fee (up to documented costs) and remit to the Driver. Tolls, parking, and similar pass-through charges reasonably incurred to complete the booked trip may be added to the Rider’s charge or reconciled in the Driver payout. Receipts/photos may be required.


7.9 Promotions, Coupons, Discounts, and Credits (Updated)

Kamel Ride may issue promotional codes, coupons, referral credits, or discounts (“Promotions”). Promotions:

• have no cash value;
• may be modified, limited, or revoked at any time;
• may have expiration dates, geographic restrictions, trip-type restrictions, or user-type restrictions;
• cannot be sold, transferred, combined, or redeemed off-platform unless expressly permitted;
• may not apply to certain fees, including service fees, unless stated otherwise.

Kamel Ride may reverse, charge back, or adjust any Promotion if we suspect misuse, fraud, manipulation, or violation of these Terms.


7.10 Taxes; No Tax Advice.
Kamel Ride does not provide tax or legal advice. Drivers and Riders are solely responsible for any taxes, filings, or reporting related to amounts paid or received, including any informational forms issued by Stripe.


8. User Content and Copyright Complaints
User Content. You may submit reviews, photos, messages, and other content (“User Content”). You represent you have all rights to submit it and that it does not infringe others’ rights or violate law. You grant Kamel Ride a non-exclusive, worldwide, royalty-free license to use, host, reproduce, modify, adapt, publish, translate, create derivative works from, display, and distribute your User Content for operating, improving, and promoting the Platform, subject to our privacy practices. We may remove or modify User Content that violates these Terms or law.
Copyright Complaints. If you believe content on the Platform infringes your copyright, email [email protected] with: (a) identification of the copyrighted work; (b) the allegedly infringing material and its location; (c) your contact information; and (d) a statement of good-faith belief the use is not authorized. Kamel Ride may remove content in its discretion. Kamel Ride is not designating a DMCA agent at this time and does not promise DMCA safe-harbor processing.


9. Service Provided “As Is”
The Platform is provided “as is” and “as available,” without warranties of any kind. We do not guarantee: (i) a ride will occur on time or at all; (ii) the safety, reliability, or performance of any Driver, Rider, vehicle, or route; or (iii) that the Platform will be uninterrupted or error-free.


9A. Aggregate Liability Cap
To the maximum extent permitted by law, Kamel Ride’s total aggregate liability for all claims arising out of or relating to the Platform, these Terms, or any ride shall not exceed the greater of: (a) the amounts you paid to Kamel Ride (if any) in the three (3) months preceding the event giving rise to liability; or (b) US $100. This limitation is a fundamental basis of the bargain between you and Kamel Ride.


10. Assumption of Risk
By using Kamel Ride, you acknowledge the inherent risks of ridesharing with individuals you may not know, including differences in driving behavior, vehicle condition, routing, and the possibility of delays, disputes, or non-completion. You voluntarily assume all such risks.


11. Indemnification
You agree to indemnify, defend, and hold harmless Kamel Ride and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from or related to: (i) your use or misuse of the Platform; (ii) your violation of these Terms or law; or (iii) your actions or omissions as a Driver or Rider, except to the extent caused by Kamel Ride’s gross negligence or willful misconduct.


11A. Release
To the fullest extent permitted by law, you release Kamel Ride from claims, demands, and damages (actual and consequential) of every kind, known and unknown, arising out of or related to disputes between users (including Driver–Rider disputes) or the acts/omissions of users during rides. If you are a California resident, you waive California Civil Code §1542 (and any similar statute), acknowledging this release may extend to claims you do not know or suspect to exist.


12. Modifications to Terms
We may modify these Terms from time to time. Material changes will be notified via email or in-app notice at least 30 days before they take effect. Your continued use of the Platform after the effective date constitutes acceptance of the revised Terms.


13. Dispute Resolution; Arbitration; No Class Actions
Any dispute arising out of or relating to these Terms will be resolved by binding arbitration administered by the American Arbitration Association (AAA). You agree to resolve disputes only on an individual basis and waive any right to participate in class actions or class arbitrations.
Small-Claims Carve-Out: Either party may bring individual claims in small-claims court.
Injunctive Relief: Either party may seek temporary injunctive relief in court to protect safety, security, or intellectual property while arbitration proceeds.


14. Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Subject to arbitration, any permissible court action shall be brought in the state or federal courts located in Kent County, Delaware.


15. Community Standards and Conduct
Kamel Ride promotes trust-based travel, often among users with shared affiliations (e.g., university, workplace). All users must communicate clearly, treat others with dignity, and follow Platform guidelines. Harassment, unsafe behavior, discrimination, or repeated policy violations may result in account removal.


16. Disclaimer of Liability (clarification)
Kamel Ride is a technology platform. We do not own or operate vehicles, employ Drivers, or provide transportation services. Drivers and Riders act independently and are not agents of Kamel Ride. We do not control or supervise user conduct or vehicle condition. Users participate in rides at their own risk. Drivers are solely responsible for maintaining valid insurance, licenses, and compliance with law. To the fullest extent permitted by law, Kamel Ride disclaims liability for personal injury, property damage, accidents, losses, delays, or disputes arising from any ride or user interaction.


17. Termination; Suspension; Survival
We may suspend or terminate access for any reason, including safety concerns, fraud risk, non-payment, or policy violations. Upon termination, provisions that by their nature should survive (including payments, refunds/chargebacks, licenses, disclaimers, limitation of liability, indemnification, dispute resolution, and assignment) survive. We may retain information as required by law or legitimate business interests (e.g., fraud prevention, safety, and accounting).


18. Communications Consent (Email/SMS)
By creating an account, you consent to receive service and transactional communications (e.g., ride updates, verification codes) via email or SMS. Message/data rates may apply. You may opt out of marketing messages at any time; you may not opt out of essential service communications while your account is active.


19. Third-Party Services
The Platform integrates third-party services (e.g., Stripe for payments). Your use of such services may be subject to their terms and privacy policies. Kamel Ride is not responsible for third-party acts or omissions.


20. Assignment
You may not assign these Terms without our prior written consent. Kamel Ride may assign or transfer these Terms (in whole or part) in connection with a merger, acquisition, corporate reorganization, sale of assets, or by operation of law.


21. Severability; No Waiver; Entire Agreement
If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver. These Terms, together with any policies referenced in them, constitute the entire agreement between you and Kamel Ride and supersede prior understandings on the subject.


22. Export and Sanctions Compliance
You represent you are not located in, under the control of, or a national/resident of any country or listed party subject to U.S. sanctions. You agree to comply with U.S. export, re-export, and sanctions laws in connection with your use of the Platform.
