Kamel Ride Terms of Service

1. Acceptance of Terms

By accessing or using the Kamel Ride mobile application (the “Service” or “Platform”), you agree to be bound by these Terms of Service (“Terms” or “Agreement”). If you do not agree with any part of these Terms, do not use the Service.

These Terms apply to all users of the Platform, including Riders, Drivers, and visitors. Your continued use of the Service constitutes your acceptance of the most current version of these Terms.

 
2. About Kamel Ride

Kamel Ride is operated by Ted Lim Mobility LLC, a Delaware limited liability company. The Platform provides a community-based ride coordination service that connects independent Drivers with Riders for intercity travel. Kamel Ride acts solely as a technology provider and marketplace and does not employ Drivers or operate as a transportation carrier.

Drivers are independent users who post rides, and Riders request to join them. Both parties are responsible for coordinating logistics, including pickup and drop-off locations.

 
3. User Roles

Driver: A user who offers and provides rides using their own vehicle.
Rider: A user who books a seat in a Driver’s vehicle for a scheduled trip.
User: Any person accessing, browsing, or interacting with the Platform, including Drivers and Riders.
Kamel Ride facilitates the discovery and coordination of trips but does not guarantee the quality, timing, or safety of any Ride.

 
4. Driver Responsibilities and Liability

Independent Contractor Status

Drivers using the Platform are independent contractors, not employees or agents of Kamel Ride. Drivers are solely responsible for:

Complying with applicable traffic laws and licensing requirements.
Carrying valid auto insurance meeting state minimum liability standards.
Ensuring their vehicle is safe, legal, and operable.
Kamel Ride does not verify insurance coverage beyond the driver’s agreement that they have valid insurance.

Accident Liability

Drivers are solely liable for:

Any accidents, damages, or injuries arising during a Ride.
Losses or claims due to negligence, reckless driving, or illegal activity.
 
5. Rider Responsibilities

Riders are expected to:

Arrive on time and at the agreed pickup location.
Behave respectfully and safely toward Drivers and fellow Riders.
Only book rides with Drivers they are comfortable sharing a trip with.
Riders assume all risks associated with participating in a Ride.

 
6. Verification and Safety Measures

Kamel Ride may in the future review user-submitted information such as driver’s licenses or insurance documents, but currently does not collect documents or conduct background checks.

We may add onboarding steps later, but Riders and Drivers acknowledge that:

Kamel Ride does not guarantee the identity, safety, or driving capability of any Driver.
Each user participates in a Ride at their own risk.
Kamel Ride does not supervise or monitor the conduct of Drivers or Riders in real time.
 
7. Payments and Fees

For Riders

Riders pay at the time of booking via Stripe.
The total price includes the Ride cost and a service fee charged by Kamel Ride.
Optional tips can be added for Drivers and are paid out in full.
For Drivers

Drivers receive payment after a completed Ride, minus Kamel Ride’s service fee.
Drivers may not accept off-platform or cash payments for rides arranged via the Platform.
 
8. Service Provided “As Is”

The Kamel Ride Platform is provided “as is” and “as available” without warranties of any kind. While we aim to build a safe, trusted platform, we do not guarantee:

The safety, reliability, or performance of any Driver or vehicle.
That a Ride will occur on time or at all.
That the Platform will operate uninterrupted or error-free.
 
9. Limitation of Liability

General Disclaimer

To the maximum extent permitted by law:

Kamel Ride is not liable for any indirect, incidental, special, punitive, or consequential damages.
This includes damages arising from your use of the Platform or participation in any Ride.
Exclusion of Damages

Kamel Ride is not liable for:

Any injury, property damage, or loss during a Ride.
Accidents, cancellations, or disputes between users.
Misrepresentation or misconduct by a Driver or Rider.
 
10. Assumption of Risk

By using Kamel Ride, you acknowledge and accept the inherent risks involved in ridesharing with other individuals. This includes:

Riding with someone you do not know personally.
Variations in driving behavior, vehicle condition, or route quality.
The possibility of delay, dispute, or non-completion of a trip.
You voluntarily assume all risks associated with using the Service.

 
11. Indemnification

You agree to indemnify, defend, and hold harmless Kamel Ride, its owners, officers, employees, and agents from any claims, damages, or liabilities (including attorney’s fees) arising from:

Your use or misuse of the Service.
Your violation of these Terms.
Your actions as a Driver or Rider, except in cases of Kamel Ride’s gross negligence or willful misconduct.
 
12. Modifications to Terms

Kamel Ride reserves the right to modify these Terms at any time. Users will be notified via email or app notification at least 30 days in advance of any material changes. Continued use of the Platform after changes are made constitutes acceptance of the new Terms.

 
13. Dispute Resolution

Arbitration Agreement

Any dispute arising out of or relating to this Agreement shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA).

No Class Actions

You agree to resolve disputes only on an individual basis. You waive the right to participate in class actions or class arbitrations.

 
14. Governing Law and Venue

These Terms shall be governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any legal dispute shall be brought in Kent County, Delaware, unless resolved via arbitration.

 
15. Community Standards and Conduct

Kamel Ride promotes trust-based travel. Most users ride with people from their university, workplace, or mutual social networks. All users are expected to:

Communicate clearly.
Treat others with dignity.
Follow platform guidelines.
Harassment, unsafe behavior, or discrimination is grounds for account removal.

 
16. Disclaimer of Liability

Kamel Ride is a community-based technology platform operated by Ted Lim Mobility LLC. We provide tools to help connect independent Drivers and Riders for shared travel, but we do not own or operate vehicles, do not employ Drivers, and do not provide transportation services.

All Rides arranged through Kamel Ride are independently coordinated between users. By using the Platform, you acknowledge and agree that:

Drivers and Riders act independently and are not agents, employees, or representatives of Kamel Ride.
Kamel Ride does not control, supervise, or monitor the conduct of any user or the condition of any vehicle.
Kamel Ride does not guarantee the safety, punctuality, legality, or outcome of any Ride.
Users participate in Rides at their own risk.
Drivers are solely responsible for maintaining valid insurance, licenses, and compliance with all applicable local, state, and federal laws.
To the fullest extent permitted by law, Kamel Ride disclaims all liability for personal injury, property damage, accidents, losses, delays, or disputes arising from any Ride or interaction between users.

Your continued use of the Platform confirms your understanding and acceptance of these limitations.
